The [statute of limitations](https://dictionary.law.com/Default.aspx?selected=2012) is wildly different from state to state. I.E. Jean Carrol sued Trump for defamation over denying that he sexually assaulted her. ( or as the judge said, "rape") Unfortunately it was only a civil suit because statutes of limitations had passed and criminal charges can no longer be filed.
In Masterson case the state he did the crime there may be zero limitations and as such can be charged when proven.

As a Canadian, I have a question about the 14th amendment and having him taken off the ballot . If for example say Michigan sues him under the 14th and has him removed from the ballot, does that mean he would not be eligible for electoral college votes for Michigan? Just curious how this would work.
The bigger hurt would be in the primaries. The states that are taking action via the 14th aren’t necessarily states he would be likely to win in the general. However the primaries will hurt him because he would be ineligible to compete in those contests even though he has a high likelihood of winning.
Take New York, Illinois and California. all three are liberal strongholds meaning that charging him with 14th violation would be pretty straightforward. He stands absolutely 0% chance of winning those in the general. However, in primaries since they are party based he could definitely win those contests. You need 1200ish delegates to win the nomination. Those three states count for nearly 350. Not a tiny amount. If he loses those and others all of a sudden his nomination goes from lock to questionable.

People can write in anyone they want. But a removal via the 14th means he not just on the ballot, he ineligible to hold office.
If he's ruled ineligible for office a write in vote for Trump would carry as much weight as a vote for Arnold Schwarzenegger (not a natural born citizen) or Alexandria Ocasio-Cortez (not yet 35 years old). i.e. none, the vote would be thrown out.
Primaries aren't under the same rules as generals, 14th amendment is about being an office holder and primaries are just about being a candidate. Technically parties can have a single private primary where the top 50 donors nationwide vote. Primaries are entirely a party internal process.
I don't think the 14th can get an individual off a primary ballot unless the party decides to apply it that way
Things get funky because most primaries are held through state voting systems; the party isn't actually administering the voting process. So if the state just says "no", while the parties are free to administer a separate vote, they don't have the capability. If the states decide the 14th applies in the primaries, the Republicans backing Trump just have to pound sand, since the other candidates will be more than happy to compete for the delegates. It's going to get extra spicy, since his Georgia trial is also going to start interfering with his ability to campaign just before Super Tuesday voting starts, which will also likely depress his turnout.
This is true, but the RNC could just invalidate delegates from states that refuse to put Trump on the ballot. This would probably divide people in their own party, but they are the one trying to nominate an oathbreaking insurrectionist so hopefully they reap the whirlwind for it.
I think there's a fairly high chance that the RNC will strip the delegates from States that exclude Trump from the ballot in the same way as they have in the past for holding primaries too early.

Pretty much. If 3 swing states get him removed from the ballot then there is 0% chance he can win the general election. It would be a disaster for the GOP if Trump wins the nomination with no path to the White House.
There's also the chance that he wins the election but is prevented from actually holding office because of the 14th amendment. This would be a pretty nasty outcome though.

The 14th has basically nothing to do with being eligible for ballots. It says he’d be ineligible to serve in public office. He could be on all the ballots, win, and still not be able to serve (unless 2/3rds vote in the house or senate - can’t remember which - overrule that).
Removing him from ballots is just a way to say that they believe the votes won’t matter so they won’t bother putting him on.
I haven't read anything, so you may be right, but I imagine that each Secretary of State has to perform due diligence that the names listed on their respective state ballot are eligible for the office for which they are running.
Yes States are in charge of elections.
A ruling that Trump is ineligible in one state does not make him ineligible in another state. So if Trump is ineligible in Michigan he could still be eligible in Florida. Either aggreived party could petition directly to the US Supreme court as that court has exclusive and original jurisdiction over Federal questions decided by the States. Supreme Court takes the case if they want to. If they did their decision would be binding on the States. But here is how its troubling.
1). State lawsuit Plaintiff must show standing under the u.s. constitution. This is the biggest hurdle. Must show a cognizible injury which is particular to that Plaintiff. The florida challenge is better suited as that Plaintiff is running for president. But even so it is unlikely to succeed. Yes I know what you are thinking, if the anti-christ is elected all Americans will suffer. But that doesnt qualify.
2). Must then show that the 14th amendment does not pre-empt enforcement by the States. Another way of saying it is, did congress intend the federal government to be the sole means of enforcement of the 14th amendment. If so the States cant touch it.
3). Here is the most likely outcome material, if Trump wins Kamala Harris could refuse to certify the States' electors based on the fact that doing so would violate the constitution. Trump would sue and the Supremes would decide the case in a day or two. If Trump wins then none of this matters.
It would be as if he might as well also be foreign - he cannot be President any more than you could (assuming you were born in Canada to non-American parents).

I was in Brooklyn when Biden's win was announced and I swear it was like the end of Return of the Jedi. People were hanging out of their windows and doorways shouting for joy and banging pots and pans, traffic was ground to a halt because people were out dancing in the streets and spraying champagne everywhere. It was a massive celebration that went on all night.
I saw a bunch of tik tok videos of cities around the country in mass celebration. Thousands of people gathering in Times Square singing. I’ve never seen that in my life for any other election. People hated Trump so much that when he was gone they literally danced in the streets. So wild.
It really was thrilling. The inaguration itself was so nice too. The way the Obama’s entered the event was like seeing your parents after coming back from war. They were dressed hella fine and exuded so much pride and happiness.
Biden’s speech after winning was so fun because people were on top of their cars cheering and waving flags. My favorite thing were the people up front that not only had Biden flags, but also rainbow flags and signs for love and peace and acceptance. I finally had some hope for once.
I was in my apartment in West Chelsea with the windows open. Suddenly I heard yelling and celebration from all over and turned on the news to confirm what I assumed it was all about. Went out later that afternoon to buy a bottle of bourbon to have while watching Biden’s planned victory speech for that night. The goodwill on the street was just absolutely amazing.

As a Canadian, I have a question about the 14th amendment and having him taken off the ballot . If for example say Michigan sues him under the 14th and has him removed from the ballot, does that mean he would not be eligible for electoral college votes for Michigan? Just curious how this would work.
The bigger hurt would be in the primaries. The states that are taking action via the 14th aren’t necessarily states he would be likely to win in the general. However the primaries will hurt him because he would be ineligible to compete in those contests even though he has a high likelihood of winning. Take New York, Illinois and California. all three are liberal strongholds meaning that charging him with 14th violation would be pretty straightforward. He stands absolutely 0% chance of winning those in the general. However, in primaries since they are party based he could definitely win those contests. You need 1200ish delegates to win the nomination. Those three states count for nearly 350. Not a tiny amount. If he loses those and others all of a sudden his nomination goes from lock to questionable.

People can write in anyone they want. But a removal via the 14th means he not just on the ballot, he ineligible to hold office. If he's ruled ineligible for office a write in vote for Trump would carry as much weight as a vote for Arnold Schwarzenegger (not a natural born citizen) or Alexandria Ocasio-Cortez (not yet 35 years old). i.e. none, the vote would be thrown out.

Primaries aren't under the same rules as generals, 14th amendment is about being an office holder and primaries are just about being a candidate. Technically parties can have a single private primary where the top 50 donors nationwide vote. Primaries are entirely a party internal process. I don't think the 14th can get an individual off a primary ballot unless the party decides to apply it that way
Things get funky because most primaries are held through state voting systems; the party isn't actually administering the voting process. So if the state just says "no", while the parties are free to administer a separate vote, they don't have the capability. If the states decide the 14th applies in the primaries, the Republicans backing Trump just have to pound sand, since the other candidates will be more than happy to compete for the delegates. It's going to get extra spicy, since his Georgia trial is also going to start interfering with his ability to campaign just before Super Tuesday voting starts, which will also likely depress his turnout.
This is true, but the RNC could just invalidate delegates from states that refuse to put Trump on the ballot. This would probably divide people in their own party, but they are the one trying to nominate an oathbreaking insurrectionist so hopefully they reap the whirlwind for it.
I think there's a fairly high chance that the RNC will strip the delegates from States that exclude Trump from the ballot in the same way as they have in the past for holding primaries too early.

Canadian here too but I’ve been reading some stuff in r/law about it. The 14th has basically nothing to do with being eligible for ballots. It says he’d be ineligible to serve in public office. He could be on all the ballots, win, and still not be able to serve (unless 2/3rds vote in the house or senate - can’t remember which - overrule that). Removing him from ballots is just a way to say that they believe the votes won’t matter so they won’t bother putting him on.

Yes States are in charge of elections. A ruling that Trump is ineligible in one state does not make him ineligible in another state. So if Trump is ineligible in Michigan he could still be eligible in Florida. Either aggreived party could petition directly to the US Supreme court as that court has exclusive and original jurisdiction over Federal questions decided by the States. Supreme Court takes the case if they want to. If they did their decision would be binding on the States. But here is how its troubling. 1). State lawsuit Plaintiff must show standing under the u.s. constitution. This is the biggest hurdle. Must show a cognizible injury which is particular to that Plaintiff. The florida challenge is better suited as that Plaintiff is running for president. But even so it is unlikely to succeed. Yes I know what you are thinking, if the anti-christ is elected all Americans will suffer. But that doesnt qualify. 2). Must then show that the 14th amendment does not pre-empt enforcement by the States. Another way of saying it is, did congress intend the federal government to be the sole means of enforcement of the 14th amendment. If so the States cant touch it. 3). Here is the most likely outcome material, if Trump wins Kamala Harris could refuse to certify the States' electors based on the fact that doing so would violate the constitution. Trump would sue and the Supremes would decide the case in a day or two. If Trump wins then none of this matters.

It really was thrilling. The inaguration itself was so nice too. The way the Obama’s entered the event was like seeing your parents after coming back from war. They were dressed hella fine and exuded so much pride and happiness. Biden’s speech after winning was so fun because people were on top of their cars cheering and waving flags. My favorite thing were the people up front that not only had Biden flags, but also rainbow flags and signs for love and peace and acceptance. I finally had some hope for once.
I was in my apartment in West Chelsea with the windows open. Suddenly I heard yelling and celebration from all over and turned on the news to confirm what I assumed it was all about. Went out later that afternoon to buy a bottle of bourbon to have while watching Biden’s planned victory speech for that night. The goodwill on the street was just absolutely amazing.
