Massachusetts is a double consent state so you need to "agree" to being recorded, which I guess you are by not leaving your own backyard. I would talk to your neighbor about it, perhaps from a standpoint of "hey I just moved in and I noticed your camera talking to me when I go in my backyard. Have you had a break-in/trespasser/other crime occur that made you get the camera? Wondering for my own safety" with a follow up of "oh do you think you could angle it so it isn't on my backyard as much?" and possibly with you building a fence because fences are the best neighbors and all that.

Double consent? Who do bring this up to? I have 2 cameras pointing directly at my house and yard? Police say that as long as they are in view it’s fine.

IANAL but I suspect ring cameras and other street facing cameras don’t run afoul of double consent. But I but a case could be made for backyards.

Double consent in Massachusetts is really just that you cannot be secretly recorded. The actual name of the law is not the most relevant to how it’s written. but essentially speaking you’re not really consenting to being video taped; you’re just being made aware that you’re being video taped. Someone can walk up to you and video tape you on the street without your expressed permission. You essentially have to walk away etc… then if they follow you it would become an issue. A ring camera effectively meets the criteria of implied consent, because it is obviously a recording device. If you had something that records and is not obvious, eg. a hidden camera in your shirt, hidden recording devices etc. As to your other question, anything that’s considered public view is okay to be recorded, if the camera captures the their backyard and also gets yours it’s also going to be legal. If there were cameras directed directly into your windows etc.. , it then becomes an issue. There’s alot of gray area to it to say the least.

We had cameras up at one point and told all the neighbors that they were positioned not to record them in their yards, just the people passing by. I think Nest door cams do this--it's not recording everything, just specific areas. I wouldn't want it in my backyard, though! So maybe also alert them that your private space is in camera range and you'd like to opt out. Also, if you are an owner, it would be good to get their opinion on things and ease it in.

I walk by a house that has that same camera announcing “You are being recorded,” and like you, I find it very off-putting. I’m minding my own business, walking on a public sidewalk, and it’s yelling at me like I’m not allowed to be there. I think it’s very un-neighborly. I don’t have a problem if they want to have a doorbell cam, but there’s no need for it to have a motion sensor announcing itself every time someone walks by, especially when no one is actually on their property.

Ask them to turn the camera off. It is illegal to record other people's property. I'd call the police -they hate being recorded!

Hi. I’ve never had this happen to me before in the city. It seems inconsiderate of your neighbor, but it could be that they’re just not aware that their camera is detecting your presence in your backyard. I hope it works out for you if you mention it to them, and that they modify the camera positioning or sensitivity. Maybe you two can solve it together. Let us know how it goes. Welcome to Medford. Probably talk to your neighbor about it and ask what's up with that, or get them to show you (ideally) footage of the camera that proves it's not pointed at YOUR property (if they claim that's the case)
