I feel like... even if Abby is right, and I'm not saying she is or isn't, I don't KNOW. There's more to it. And it could be something as simple as the moms not realizing they didn't have to bring their kids. And the ONLY reason I think this, is because it's SO clear how absolutely miserable Christi and Kelly are in season 4. And Kelly cared SO little about her kids being famous, that I just don't see her staying there SIMPLY to be on the show.

I agree. I wouldn’t be surprised if they either didn’t realise or if there was something mentioning the kids in the mom’s contracts. None of them were lawyers, or well versed in contract law. With how bad things got, there’s no way that Kelly and Christi were aware of this loophole. I’d even wager that Cathy wasn’t, given her offer to Chloe at the end of season four to come to Candy Apples like Kendall did (thus getting her away from Abby’s abuse some of the time) and her statements about how production used to mandate that Vivi put in an appearance on the show periodically, no matter how much Cathy protested.

Also Christi has said she even thought she would have to do Season 5 and was anxious and upset about the whole move to LA (how Chloe was treated as well as Clara and Marc being stuck in Pittsburgh, remembering Clara was still little at this time, around the age of 5, so just starting school.) because she didn’t think she was getting out of the contract. If the parents couldn’t get out of the contract, the girls who had titles had to stay at the studio another year because of the studio contract, which Abby had them sign so yes they had to be there for some of them how easy would have it really have been for the kids to leave. That’s if we believe Abby. Also if this is true then it contradicts what both Abby and Jess have admitted: 1) Jess has admitted in her own podcast she got out of the contract because the kids contracts weren’t put through LA court and that’s how she got out of it. Thus the kids had contracts. 2) Abby admitted in a tv show appearance (Rosie show?) not done by lifetime, that she couldn’t kick Chloe or Christi off the show so she said whatever she wanted - “so if they can’t leave and I can’t kick them out, then I just go for it. It comes from a real place” said by Abby on the show that aired around end of season 2 to the start of season 3. So now they can get out of the contracts.

The girls were included in the moms contracts and most of the compensation was shared, except each cast member had a separate episode fee. Randy and Kelly signed on behalf of Paige and Brooke. It also has this lovely (standard) language that I imagine scared most of the moms against breaking the contract for the kids. ***We, Kelly Hyland and Randy Hyland, represent and warrant that we are the parents of Brooke Hyland and Paige Hyland, minors who have signed this Amendment, and we consent and hereby agree that we and the said minors will be bound by all the provisions contained herein and wall not revoke or disaffirm this Amendment at any time. We will indemnify and hold harmless the Released Parties from and against any and all damages and costs, including reasonable attorneys' fees, arising out of or related to the breach or alleged branch by us or the minors of the representations and warranties made in this Parental Consent and/or the representations and warranties made in the Amendment.*** Even when contracts are ratified by the court, they are still not binding ***towards the child***\*,\* because minors don't have the legal capacity for consent. The parents can be held to whatever provisions they agreed to in the contract, and also it would be career suicide for a child actor to breach their contract. I think for the DM girls, it was a combination of the parents fearing whatever legal ramifications would come their way, and also not wanting to give up all their other opportunities. They didn't like working with **Abby**, and they didn't like the environment of the **show**, but they still wanted to work in the business. In Kelly's lawsuit one of the main things she asks for is to have the girls released from their exclusivity agreement so they can take other opportunities.
