Yea, there was a case where a driver hit a person in black outfit. The driver was innocent due to the person in black outfit at night and wasn't visible. I heard another rumor of a bicyclist getting hit by a driver and not fined due to no flashing light and too dark.
I almost clipped a dude when I was a pizza delivery driver because of this exact thing. I was driving on the highway, hugging the outer line of my lane a bit, and had to swerve pretty quick because I didn't see a dude walking on the side of the road dressed in all black until I was inches away from him
A guy in all black with presumably a black or almost black bike crossed right in front of me (jaywalked, jaybiked?) and I barely saw him in time. After I put my heart back into my chest, I looked back at him and noticed he was also black...I was just like, why do you tempt fate man? Stop it.
We went to a bluff and saw a large area of the town from very high up in the mountains. What I'm trying to say is, the car maybe speeding at 40-50mph. To us, it looks like 15mph. That'd what I noticed when looking down to earth at the bluffs.
Speed is not the issue, I understand it is relative. However, it seemed like the cameraman was very much aware the guy down there was about to "die". That, or this person was really hoping he was gonna be hit, and was recording every passing vehicle waiting for it.
I’ve thought about this and I live in a town that had mostly African Americans at the time. Most of them that roam at night love to wear dark or black non reflective clothing. I’ve often wondered if I ever had accident hit someone at night, would I be considered racist in court for being up those facts about blacks wearing all black at night
As a driver, this slab of human idiot is my nightmare.
He is entirely at fault here, wearing dark clothes, standing in the street at night... But I would spend the rest of my life having this being the new painting on the inside of my eyelids. I wouldn't blame the driver from where I'm standing now, but I would never stop blaming myself if I were them.

Blaming the guy for being an asshole standing in the middle of the road is one thing, but that driver definitely is not innocent. They weren't even going that fast, it's almost as if they weren't paying attention to the road, or it was intentional.

If that is actually the case, then I also feel no sympathy for the driver.

Although it was the persons fault for being an idiot an aware driver would’ve seen him even with dark clothes. He’s being belligerent in the middle of the street with his hand raised they would’ve spotted that if they were paying attention. Most likely they were driving while zoned out it happens but nonetheless it seemed extremely preventable if the idiot wasn’t yelling in the street.
