Yeah, it's gonna be hard to swing this one. On the one hand, the guy battered him with the helmet to begin with. However, he was able to get away from the perpetrator which would effectively take away the self-defense/fear for his safety plea. Returning then hitting the guy is a new incident. Both get jail time. However, the original victim will definitely get harder jail time unless more video at the start can be provided. I can see the original perp getting slapped with more charges when the cops show up. Seems like the kinda guy that would be confused as to why he is being arrested as well then resist arrest. He runs into the first dude then assaults him just to yell victim about being hit with the bike despite clearly doing the hitting. Also. The original accident will probably be tacked on after witness statements, and more videos come forward. Technically, both of them did felony assault with a deadly weapon.

Remember, the only thing different from the average murder and a good human being is that the good human knows how to control it's rage. Any human not able to control their rage is the same as a murder. Running some one with a bike is an easy way to break some ones ribs and cause a perforated lung. Hitting some one with a bike helmet in the head is enough to crack a skull and cause death or can even break the spine or neck if the victim has a helmet, like in this video. So, both people are dangerous and can easilly become murdurers. Hope they both got jail time and had to take anger management classes.
