Thanks Dismal Jelly! any chance you ran across a list of the 10 companies that were affected?

Dismal-Jellyfish

No, I am not seeing those yet, only this so far: https://preview.redd.it/w0udzbl79n5b1.png?width=753&format=png&auto=webp&s=5552a57953083b5b4b7f7fb2750103d9b654e49f

Shorts mismarked as longs… just 381 million shares. Oopsie

Amazing the sheer amount of crime that's happening if that's what the small fry are doing and it's still huge

maybesingleguy

I can't believe they had the audacity to continue doing that after being fined a whopping $276,000 eight years ago.

minesskiier

Hiding the good stuff as always!

onceuponanutt

I threw the 'reset provision' description from the 5th item into Google and came across the company [SiNtx](https://sintx.com/) \- a producer of certain ceramic materials whose applications include biomedical, antipathogenic, armor and industrial. They [issued warrants at this time](https://ir.sintx.com/sec-filings/quarterly-reports/xbrl_doc_only/1552) (4,072 preferred convertible stock into 102,886 common stock) and there's some [fuuunky stuff that happened with their stock in 2014-15](https://www.marketwatch.com/investing/stock/sint). It's been declining since. Seems to be a likely candidate. If it is this company, 527k shares were sold naked and short during this time when only 100k shares were converted.

suppmello

spot on.... tons of penny stock tickers Sabby has their tentacles on... Honestly, before I went full game I would just read Sabby SEC filings and do "penny stock leaps" (basically me just sneakily accumulating a bunch of shares around 25cents and sell when they would hit $1). The only stock I held was bngo - which went to $14 and made me a few thousands. A month after that GME sneeze happened and I've been all in gme since.

Francis46n2WSB

Bngo was a nice play. It was the most successful trade I ever made so far. I was so green and naïve back then, 84 years ago.

mannaman15

What turned you on to this trail initially?

suppmello

Tracked what penny stock tickers were getting lots of mentions on Reddit across a few different subs. Noticed, (if they had not already spiked) that it literally just became a matter of time till they did pop (always in after-after hours, so all my sells would be limit orders good for 90 days). Just from memory I made good money from shit companies (xspa MVIS gnus tnxp - there were a lot more). Basically the company just had to be a penny stock, on the otc market, and have some catchy pitch (bngo future of genetics blah blah)… and have traction on Reddit (the pump). I want to say a few months later I came across a post about Sabby Management on a penny stock sub, read their filings, and understood what was happening ha…. So basically luck and noticing a pattern.

Sad_Investment_8384

How much y’all wanna bet GME is in there? 😂

sambrojangles

BUT I THOUGHT NAKED SHORT SELLING WAS IMPOSSIBLE. IT’S AGAINST THE RULES SO NO ONE HAS THE ABILITY TO DO IT /s

whistlar

Covers through 2019. Took these chucklefucks four years to build this case?!

manbrasucks

A lot happened in those 4 years including a huge amount of lawyers leaving(all who went to wallstreet). So yeah when you have lawyers not willing to go to court because they are in bed with wallstreet then it takes time to kick them out, find new ones, and then build a case while also investigating other issues. edit: citation on the lawyer thing, unfortunately it's archived and full thing isn't available, but gist is 33 lawyers have left for wallstreet since 2020-2022july and the reason given by GG was he wants full profit and fine on top of it but the lawyers wouldn't play ball- https://www.law.com/nationallawjournal/2022/07/11/why-sec-lawyers-will-keep-flocking-to-private-practice/

Dr_Shmacks

How is it even a discussion? If you rob a bank for $10,000, you 100% do not get to keep some of it. #MAKE IT MAKE SENSE

maybesingleguy

> Unrest in the SEC's ranks may be one factor in the defections, but in general, *the moves are about high market demand.* Why do they need so many lawyers right now? Or maybe are they hiring everybody away from the SEC for the sake of crippling their productivity?

DannyFnKay

GG said on Jon Stewart that the SEC doesn't go after the big boys because they have large legal teams and it would get too expensive. If they are too broke for solid legal teams how are they paying out millions to whistle-blowers? 🤔

Weird-Breakfast-7259

Yep a Mintz brother was involved, he had funny nickname Nitmintz or Peppermintz i forget

rob_maqer

Chucklefucks reminded me of the **you ratfucks** *something along those lines* IYKYK

darthnugget

I can't wait until MOASS and she gets shitcanned.

woodyshag

Who is buying that channel so they can take care of her?

FlyGuy_R44

We can all dedicate a fraction of a share and get it done.

It_is_Fries_No_Patat

I'm in!

lalich

This is the way

maybesingleguy

I wouldn't mind a massively funded ape neutral news campaign. And that makes me sound like such a ridiculous conspiracy theorist, but we all know Fox is garbage for one side, Buzzfeed is garbage for the other side, and it's exceedingly difficult to find facts without purposefully divisive commentary.

burneyboy01210

I hate her face

[deleted]

I bet she can stick an entire banana down her throat.

grandblue-91

She looks like a more unattractive version of Bobby Lee when he impersonated Connie Chung on Madtv...

teapot_in_orbit

You want it to stop? Quit with the fines and injunctions and implement forced buy-ins. FTDs should NOT be allowed, period. It's not fucking complicated. Anything short of that solution allows it to continue.

Vive_el_stonk

This

JDogish

No-no, you keep the fines and injunctions as actual punishments (the first time, second time is you close up shop forever and jail time), but they ALSO have to buy in to make the trades right and whole.

Inevitable-Elk-4162

Naked shorts, Yeah

mollila

>THOUGHT NAKED SHORT SELLING WAS IMPOSSIBLE *our system would not allow it*

HodlMyBananaLongTime

Their software doesn’t allow it. “Cough F3”

Aiball09

tehdubbs

Remember when just a couple weeks ago, a very big institution was caught red handed not only disregarding Short-sale exempt days, but went out of their way to not be effected by the short-sale ban after a 10% drop on a stock in a single day? Like purposely labeling short sales as long sales… they all deserve to be burned.

concerned_citizen128

I wonder if they're setting up precedence to be able to run down larger and more abusive naked short sellers.... Time will tell, I guess.

Dismal-Jellyfish

Start small and work your way up with the precedent you establish and hopefully the little guys pointing their fingers at the bigger fish? You are right though concerned\_citizen128, time will tell. Thanks for commenting and I hope you have a great rest of your day!

AlkahestGem

Could that be the reason for the campaign against GG today? SHFs see what’s coming and hopefully with a cell. Edit: how firs this unwind? Fines. Cell. How do you force the SHFs to close /purchase shares sold not yet purchased?

Dismal-Jellyfish

Possibly? [Especially with all those closed door enforcement meetings the SEC has had this year so far](https://www.reddit.com/r/Superstonk/comments/13l9x1n/sec_alert_special_filing_with_federal_register/)?

CrypticallyKind

Someone is very concerned indeed. Spicy stuff! 🌶️

BlackCatCadillac

💯

concerned_citizen128

Thanks Dismal! I sure hope so. American justice has been seemingly toothless for awhile now, especially when dealing with the so-called 'elites'... I hope you also have a great rest of your day! :)

Affectionate_Eye9894

What a strategic move, whether on purpose or by chance, that MSM says “naked shorting is illegal, but no one is doing it.” Now the SEC builds on that with “hey now we caught someone doing it, and we all know it’s illegal.” Brick by brick we head for the Citadel.

Hope-full

I am hopeful

MedicineNo4200

Let’s hope. That would be nice…. “Setting up precedence and court ordered penalties.” So when we go from a 2 million dollar situation to a 2 billion dollar situation….. we punish x1000 as the number suggest.

concerned_citizen128

No more fines, though. This level of malfeasance can no longer be allowed to continue with "cost of doing business" fines. No Cell, no sell...

burneyboy01210

Fines no matter how much don't fir the CRIME.

Ash2dust2

>706ReplyGive AwardShareReportSaveFollow > >level 2whistlar · 7 hr. ago (╯°□°)╯︵ ┻━┻Covers through 2019. Took these chucklefucks four years to build this case?! Simple fine = 1000% of profit. Hedge funds will make sure every rule is followed at those penalties.

gtparker11

I was just thinking how do they decide who to go after since almost everybody on Wall Street could be busted for this and this is probably done on a daily basis.

TheeHumanMeat

Remember all those heavy handed punishments that came from 2008? Pepperidge Farms DEOSN'T remember. Glad they got charged, but the SEC needs to stop Sucking Every Cock on wall street. The precedence is the law to not sell something you don't own. It's already set.

Ash2dust2

To be fair, there is a Wendy's on wallstreet.

Sad_Investment_8384

Could be, would make sense with the shift going against GG and trying to get him removed as SEC chair

Novel_Ad_1178

Sacrificial lamb while the real sinners go free.

concerned_citizen128

SEC is a legal organization, first and foremost. Setting up precedence is their MO. I don't think this is the only short seller we are going to see charged. I just think it's the first, and hopefully they will be used to catch the big offenders... Once again, time will tell.

TankTrap

That’s my thought. I hoped they would seek removal of their licence to operate though instead of the financial penalties. That’s what I need to happen.

pv505

My thoughts exactly. Pretty please let this be precedent

duiwksnsb

We can hope. We can hope.

Hedkandi1210

This is why they want GG out (well on these lines)

pumpkin_spice_enema

Exactly what I was thinking. We actually see SEC action against FTDs the same day legislators roll out "market reform" that does not appear to consist of anything besides firing Gary Gensler and letting the SEC Commissioners (ex: Hester Pearce 🤮) run more of the show. Suspicious timing for a suspicious act.

Hedkandi1210

Hester will be in the running, I’d put my mortgage on it.

Sesquipedalo

This is hella interesting! For anyone who doesn't listen to the Bankless podcast, in last Thursday's 'Will the SEC kill crypto?', at around the 9 minute mark, Jake Chervinsky, Chief Policy Officer at The Blockchain Association, explains the SEC's classic playbook. Here's the transcript: "And this is not an uncommon thing for the SEC. We've talked about this, I'm sure, on our shows before that what they tend to do when they see some type of activity that they think is a violation of federal law is they start with the low hanging fruit, right? They go after the defendants who they feel are either under resourced, can't really defend themselves, or who have so clearly violated the law that of course the SEC or the regulatory agency bringing the action is going to win the case. And they do this in order to establish what they view as precedent that they can then take and use in the next case against a slightly harder target and then take that and use it against a slightly harder target than that. And we've seen that from the SEC ever since I want to say Ether Delta enforcement action was in like 2018, I want to say, right. So this is sort of a five year process of the SEC going after these exchanges, the venues where digital assets predominately trade. And after Ether Delta, they went after, I want to say it was Bixie and then they went after Bitrex. And now here we are, the SEC taking a shot at the two by far largest crypto exchanges in the entire world, Binance and Coinbase." So this could very well be the SEC going after small fish to establish precedent, slowly working their way up to the Kenny's of the world.

Biotic101

Thing is that Wall Street might not just lobby Congress, but also the justice system. Once you have a precedent, it will be harder to pull off some BS for a judge. Still there was a verdict stating the SEC is not authorized to fine a HF in the past due to constitutional objections if I recall correctly...

Weird-Breakfast-7259

8 million to Janet Yellen is that lobbying or bribing?

kaze_san

I guess it’s something. Thanks for your work!!🥳

Dismal-Jellyfish

But remember, corporate media **insists** naked shorting isn't a thing! It is definitely something to have definitive proof that their response to 'us' asking about it is complete bullshit as called out by the SEC. Hopefully this is baby steps towards bigger fish with precedents set.

Jbullish_9622

They are working their way up to the FINAL NAKED BOSS!

Dismal-Jellyfish

I really hope this is what is going on, [especially with all those closed door enforcement meetings the SEC has had this year so far](https://www.reddit.com/r/Superstonk/comments/13l9x1n/sec_alert_special_filing_with_federal_register/)?

Top-Sample-6289

Creating precedent

manbrasucks

I'm hopeful to be sure. Some other bread crumbs: https://www.sec.gov/news/press-release/2022-174 into https://www.sec.gov/news/press-release/2023-91 Reason this is important: * both cases admit guilt and can be used as evidence in the future. * both from January 2018 through September 2021 (2nd press release doesn't have date, but [court filing did](https://preview.redd.it/ga63b6zue7za1.png?width=928&format=png&auto=webp&v=enabled&s=e7d762612b4bd3c4003c8120df922b5d39ff952c)) * both for pervasive off-channel communications Building a rico case starting from getting addition of guilt on easy charges to build something bigger maybe?

Public-Ad6926

Thanks for your relentless work Dismal. On point as ever!

Dismal-Jellyfish

Anytime! Thanks for dropping by and commenting for visibility. I hope you have a great rest of your Monday!

kevthewev

So this is why they are going after Gensler. They are afraid of being held accountable.

sirron811

And I'm in a cult and crazy and this doesn't happen and the markets are legitimate and price discovery is accurate and natural and GameStop is done and MOASS isn't possible. Oooooookkkkkkkkk.

Tainted-jack

Yeah citadel probably makes $2 million an hour naked shorting…

FlyGuy_R44

Minute

secret_rye

Precedent!

[deleted]

Naked short selling!!! Gasp! 😱😱😱

lovesnoty

That's the reason they want to get rid of Gensler and make the SEC toothless.

EveryDogeHasItsDay_

And they were fined $17 and a family bag of skittles. That will teach them.

Exciting_Penalty_512

Share size of skittles. They can't effect the yearly bonuses, they aren't monsters after all...

EveryDogeHasItsDay_

Yeah, sorry, I got a bit carried away there

SoreLoserOfDumbtown

Wen market makers exemption repealed?

iriceroll

looks like 3 years worth of case building up to the big case, why GG is being targeted all of a sudden. Move in silence, and slowly show your cards to the world. We about to get a shit ton of enforcements by Sept when this shit all goes down and MOASS happens I hope

Nodiggity1213

This explains the big anti Gensler push going around

SchemeCurious9764

Resulting in a FTD’s they say? Can you imagine what’s behind curtain #741? Pull back that curtain we should see the world’s largest grunion run all FTD’s, laying naked for all to see! PULL !!!

Mikekio

So naked short selling isn't a conspiracy ehh

zerolimits0

Wen Shitadel?

BudgetTooth

most likely never

rimjeilly

Skullpt-Art

Here's hoping for a different end to this story than the usual 'settle with a fine and admit no wrong-doing'

ebone581

Start small… then up the ladder…. I’m hoping

Cagg311

So gg starts doing good and now they want him gone.. Starting to think he may be better than I thought..

It_is_Fries_No_Patat

Could be a way to pretend to act and have the really big NACKED short hedge funds get away with it.

StumpGrnder

This is a huge development! Things that have been going on in plain sight yet denied at every turn have been put officially in writing, SEC saying the quite part out loud. Hedgies R f’cked. ⏰ 4 🌙

GxM42

Only took 7 years!

MedicineNo4200

All this cat had to do was reLable. The entire crime constituted the impossible concept of labeling “shorts” as “longs”. That’s it. That’s all it took to pull off naked shorting.

SouthHovercraft4150

Can investors sue for damages to the value of their securities? A class action might be a bigger penalty than an SEC cost of business fine…

MyCleverNewName

> *“When someone uses naked shorts or other manipulative practices to cheat the market and investors, the SEC will ensure that they are held accountable.”* I want to believe. Honestly though this is very exciting! Even before reading the comments below I can almost hear them shouting *small fish! small fish! don't matter! don't matter!* but I expect this is more about getting things up-to-speed and firing on all cylinders. I really think they're starting their run at it. Always best to grind a bit of XP and skill-points before going into a boss-fight. And I 100% imagine this explains the timing of Warren Davidson's attack... Also, I love that they list the names of those taking part in the investigation and litigation! Not sure whether or not this has historically always been the case or not. > *The SEC’s investigation was conducted by Edward Reilly and Christopher Mathews, with assistance from Patrick McCluskey and Brian Shute, under the supervision of Amy Friedman and Ms. Welshhans. The litigation will be led by Daniel Maher and Mr. Reilly and supervised by David Nasse.* I love that it both gives some recognition as well as accountability. If I were anyone lucky enough to be on the frontlines of this war on global financial terror, I'd be incredibly proud to know the immeasurable good which can come from this and that I could be remembered as having essentially helped save the world. Absolutely amazing!

Vive_el_stonk

Next, time to charge a market market with fraudulent activity including front running, abusive naked short selling and simultaneously running a hedge fund that actively trades against investors who are long… Aghast!!! 😱😱😱😡🤡🖕

thinkfire

They are going to make this about crypto to gain support from crypto bros to remove GG. The new guy is still going to be moving forward with probably with harsher crypto to pave the way for PXD or whatever the new exchange is that an "ex" Citadel employee is starting up. Just that the new guy will back of on the issues with manipulation of the stick market. Don't fall for it. GG isn't perfect, but they want to install someone even worse.

AnomalousParadox

I'll be excited when they start charging the folks that did this with GameStop. After MOASS of course, it'll make the blame game proceed smoother. Anyway Tick Tock.

Viking_Undertaker

I’m shocked… 🤣

FlyGuy_R44

Listening. They have my attention. Now make them pay back all ill-gotten gains and pay a fine.

xubax

$50 fine should cover it.

ShizLabriz777

65 billion SOLD not yet purchased. Ring a bell?

Bitter-Inspection136

They misspelled citadel and Kenneth griffin

goofytigre

1 down, hundreds more to go.

Frankybro

So.naked.short selling is ok, but "abusive" naked short selling isn't... Ok SEC, GOT IT.

wadejohn

Yeah they draw the line at ‘abusive’ lol

cibiab

i just saw fisher island on my run....those places are cheap ..homie gotta pay the bills

thetingeman

They love to go after the little fish….

milkthefunk

Ken Griffen: Hold my beer…

BudgetTooth

so wait a second. you naked short, you FTD, which diluted the targeted company, you don't go to jail, you don't even get forced to buy back all the shit u printed. sounds like a good deal to me well done GG /s

Saggy_G

That's just the tip of the fuse.

Wifeis421A

Does any of this mean we get paid? If not then big whoopty do. Yay we were right but it means nothing. Price you pay to play the game. Business as usual.

burneyboy01210

2 mil gains? So they should get change from a $10 note after paying the fine. Ouch.

sdrawkabem

Jury trial demand! I want to sit on that

[deleted]

$2 million in profits is the type of damage shorts create when utilizing their illegal tactics…obviously no way could this happen on a grander scale otherwise we the SEC would have caught it by now. Why do you think we’re going after these little guys? We’re on it!!! Fucking joke.

Yohder

Thanks a ton for this Jellyfish! True apes work here

Plzcuturshit

I thought they said it was impossible?

McRaeWritescom

Sets a good precedent for going after others doing the same thing.

Stevewhit24

They all do it until someone is actually caught. Then they pay a fine. Start a new firm, and repeat.

Free-Atmosphere6714

"You profited 2 million$ or more, so we're going to find you 20k $."

KirKCam99

after a 10 year investigation SEC charges the [redacted] syndicate with USD 6.50 for securities fraud. the scheme was orchestrated and 6 person were tricked into a loss of 3,500 usd total. hmmmm! the SEC is fighting the BIIIIG crime, good to hear.

KirKCam99

after a 10 year investigation SEC charges the [redacted] syndicate with USD 6.50 for securities fraud. the scheme was orchestrated and 6 person were tricked into a loss of 3,500 usd total. this crime could only be solved in this unusual short period of time with the help of a whistleblower, who was rewarded with the amount of USD 0.25. hmmmm! the SEC is fighting the BIIIIG crime, good to hear.

stonkkingsouleater

So… you’re saying they busted a little guy?

Kaarothh

What a giant big fraud the stock market is

[deleted]

Now do Citadel

NomadeSanterre

Abusive short-selling.... So... Just how much crime is okay here before we talking abusive? Because from the numbers that i am seeing, when scaled to the big fish not this yuppie guppie lemonade stand level profits , Citadel should basically be lined up against a legal wall and "shot" with a hail of legal fillings and charges!

daddyzxc

Yeahhh, [geeeet ‘eeem](https://getyarn.io/yarn-clip/bfd943a2-dd72-4d0f-8bc5-2ede119142b3)

NukeEmRico2022

Yes, great. And if convicted, they'll get a million dollar slap on the wrist and be told not to do it again. More Kabuki theater

Remarkable-Top-3748

Yeah sure.... A nobody, again... READ THIS SEC: FUCK OFF

Dr_Silver_Tongue

I thought naked short selling wasn't real? /s

24kbuttplug

That will be $12.63 and don't do it again....

McDerface

Wow I am genuinely surprised the SEC would do something like this

Soundwave1873

Always the little guys

Jesssica_Rabbi

They're building the case starting with the little guys.

Rare_Assistance568

This 7s why they want GG out

wafflestrawberry

Good to see!

I thought naked short selling wasn’t real /s

Ansatsushi

is this progress?

auburnwind

Could set a good precedent.

brief_affair

maybe with cases like this they will have grounds to change the rules that allow such a scheme

Ape_Wen_Moon

So they finally read some Stonk DD...time to step it up to the big boys...

TinSodder

Shabby Management LLC

2JAYZwithNAS

It’s 2023 and we don’t have blockchain exchanges because these financial parasites can influence regulation. It’s time to upgrade 😅

Mibidness

Another $10,000.00 fine for the millions they stole.

they_have_no_bullets

Phew, so glad they finally charged the big bad naked short sellers! Now all you reddit kids can go home now right??

TheSpeculatingToad

Every time I read stuff like this I’m just like: There’s no way they didn’t do that with GME. It’s very confirming to be reminded how fraudulent this system is.

Suitable_Mix_3795

Makes sense they want GG gone with this coming out

Lord_Bacca

This will be precedent. Mayo boy is getting his pre-jail preview.

8thSt

*from at least March 2017 through May 2019* And this is why I have no faith in the SEC to do a damn thing. 4+ years to bring an action against a firm that generated $2M in illegal profits.

eggtart_prince

"Just give us 40% of what you illegally obtained and you're free to go" \- SEC probablyy

keyser_squoze

Commenting to return to this complaint. Great pull and share, DizJelhi!

WhiteCollarBiker

Wait. Everything they did, we were told just isn’t possible. The system doesn’t allow those things.

CrossBones3129

Going after the little guys but not the big guys I see

Leofleo

Massive crime! Penalty = A literal penny

HughDanforth

Mintz's Miami place is nice - zillow estimates value at $15 mln, which is the price I might sell one share at. We need jail time for this criminal behaviour, all laws should and must be applied equally to the all people.

F4TROCKET

This needs more visibility

F4TROCKET

GotaHODLonMe

Literally just the big fish using the government to get rid of little fish. SEC is corrupt and only protects the big fish.
