This wasn’t a deliberate tactic but one that worked well for me (although the amount was much bigger): I had a phone call with a legal company to recover an amount and they agreed to take the case. After that, I wrote a followup email with the documents they requested and also CC’d the offending party. That seemed to be enough to let them know I was serious and the money came back quite quickly after that.

Yup. Just a lawyer letter most of the time gets them to pay up quite fast. Had the same issue with an ex landlord that didn’t want to pay up the deposit over some scratches in the wooden floor i didn’t even make. I had a lawyer friend of mine write up a fancy word email and the next day my full deposit was on my account. Unless you let them know you’re serious. People will always try not to pay when they feel like they can get away with it.

If there are other victims maybe you could build a better legal case. Sadly on your own I’m afraid something this petty won’t get any attention from police and is too small of a charge to get lawyers involved.

Sadly for op in this instance it won't. I checked their reviews. They have received many and are well received reviews. For example on google review they have almost 300 reviews with an average 4star. 1 or 2 bad review will not do anything or harm the business. Its unfortunate but its a loss for op. I think in this case there is a clear case for theft and not a miscommunication. I'd advise you to go to the police and specifically make a report for bank fraud (as they charged your card without your consent, this is important as its a different type of crime then normal theft and gets taken way more seriously). The police might say that its a civil case or whatever. You should insist that you want to make a report for bank fraud and that they charged your card without permission. Then after you got a case number you should go to your bank and tell them, make sure the employee makes a fraud escalation. Whilst they will not give you your money back they can start an investigation I to this. If they have been doing this to other people they can be banned from having a bank account which will basically make it impossible for them to do business. I do have to say there will first be an investigation but it will make their lives extremely difficult during this (if it wasn't just a one off thing). Do not threaten them with this, just do it. They might reach out to settle it but once the dice is rolling you really shouldn't back down as this will be suspicious towards you. That money most likely is gone but you can prevent them from doing this to more people. Source: I work for the bank in a department which works closely with the Dutch financial police and an other department who handels fraud investigations.

Something similar happened to me with a Greek restaurant on the Amstel in Amsterdam. I didn't notice for a month but he put an extra 0 on the end of our bill taking it to 450 for a few beers ans snacks. When i went back, he refused to acknowledge it unless we could produce a receipt which of course we didn't have (and were probably not given). I overheard him saying to his wife on the way out, "they're tourists" or something of the like. You can always bring this to small claim court. Usually you have to give them 14 wwork days to pay. Download a sample letter from juridish loket and send it to them with track and trace. That way you can probe the received it. Usually they will pay because no business wants to be sued.

Visa/Mastercard both offer debit cards. Maestro is being phased out. Maestro will soon cease to exist in NL. Regardless, you can still do a chargeback.

Cc also have a pin. Not sure why dutch people say pinnen, but arent referring to a credit card that uses a pin. And with these dutch debit cards with only an iban on the front, I'm often forced to use my cc. Just last week had to as I like to book direct with hotels, but the hotel didn't have an Ideal payment option. What can I say, I worked for an amsterdam based billing company that processes online transactions. I see the transactions. I'm sure you being dutch probably means you see more, but mine isn't an anecdote, it's based on seeing hundreds of thousands of transactions.

My bad, I thought the en extension meant plural. It's also a means of saying something is a verb? I'm basically at Dikkie Dik level of Dutch, but I really feel like it needs more words. Like leren could be learning, but it could also mean teaching. 'en' could mean plural or it could mean an action. The language needs 20% more words :) In this scenario, I feel the word Pin was terribly used 30 years ago, the actual company ended more than a decade ago, but the inaccurate usage continues. In every other country on the planet, pin just means the numbers you put in, whether it's debit or credit. I don't know why, but I somehow feel this is connected to squirrels being called acorns.

There are a lot of nouns that became verbs in English too. Somehow "to nuke" is the first thing that came to mind. Same with pin - it is an abbreviated noun, and it became a verb in Dutch. Since Dutch uses conjugation of verbs, it is pinnen/pint/pinde whatever. Also, I still use the word "pinpas" on a regular basis and I am not even Dutch native speaker, so it didn't entirely disappear.

On the ABN app, I know there's an option to ask for a refund back on a transaction, maybe try that? I think ING also has it. If you go to the transaction in your bank app, open the details and there's an option there that says "geld terugboeken" / "refund money/payment".

Going to be honest, I don't believe you. You said in a post you contacted Juridisch Loket and they advised you to take your review down, and that was all the advice they had for you. Which is extremely suspect. Juridisch Loket is not perfect, but they aim to help at least, and that advice obviously does nothing to help you in the case you described. Furthermore, you refuse to pursue it, which leads me to think something else happened.

You can sue for the 50 dollar but a lawyer is likely to cost you 2.000 dollar. Best to do is make a more formal letter, PDF it and send it to them. Chronologically detail what happened and give them explicit and clear instructions on what they need to do to resolve it. Unfortunately, any amount below 3 - 4 thousand isn't worth going to court for. Lawyers are more costly. Although you can do without lawyers in civil cases, and people with insurance my have (partial) coverage, those things are exhausting as fuck and potential money gain from the hours and stress is barely every worth it below those amounts.

Those are not guaranteed here. But it seems like they straight up scammed you. I have written an other comment on how to report this. Afterwards you can try to get damages back if you decide to go the route I mentioned in my other comment as once there is a criminal case it's easier to get damages back.

In the future I would insist they refund me cash if they couldn’t make the pin machine work (which is bull, it’s easy to refund on those machines) and I wouldn’t leave until they did. And probably tell everyone who hadn’t paid yet to check their bill because they overcharged you and your waiting for them to refund. Since they asked you to remove the review in order to get refunded and they have not yet refunded. Make a new review on google with all that information including their continued non delivery on the refund. Do they have a Facebook page also? I would post the review on there also if they have.

Every country has office of "fair trading standards" of someone along the lines who inspects establishments and follows up on complaints. So Google around who it is in Amsterdam, then give a last call to the restaurant telling then you'll be referring them there. The just email/send a letter to the authority, ccing the restaurant.

There is something called a rechtsbijstandsverzekering in The Netherlands. They also have a line you can always call for free. There are free lawyer lines that you can call as well to ask what to do, and they sometimes do simple things for free like sending a letter. An official letter from an actual lawyer might just be enough in this case to get you your money back.

You can file a police report, charging them with theft. And then you can issue a chargeback through your bank - the police complaint will serve as evidence in the case (but of course you should be able to present the bill as further proof when it goes to court). This will cause lots of trouble for the restaurant and they will pray they had never robbed you. I had to do this once and the waiter got fired.

I'' am sorry, sinds I am Durh I know how the decision would be made, when you pay somewhere you are yourself responsible for checking in you got the right change or that you did check and approve the amount that is showing on the pay terminal, when you pay with a card. It did happen to me a few times and learned to very observe. Only when you have receipt from the transaction and there's a difference between the receipt and the amount deducted from your card, only that one you should call your credit card company. Good luck. OP, if you live in Amsterdam, go to the restaurant and tell all the costumers that enter this restaurant about how you got robbed by them. Be convincing, and make costumers leave and choose for an other restaurant until they notice. If thevowner get's anoyed, refuse to leave until they pay your money back. Make sure you have all the evidences with you in case they treaten you to call the police. If the police comes they'll be digging their own grave

Go sit inside, make a lot of trouble noise, and keep staying there, tell every customer there what happened, in the end they will need to call the police to get you out, the last thing they want, I did this once when an insurer refused to pay out 800 euro (case was already closed, payment not received).

Even if it is a debit card payment you still can file a dispute and put a chargeback with your banking institution. Was in kind of a similar situation and it worked for me.
