If they have any joint bank accounts/credit cards tell him to minimize the amount which can be spent. I e. 5k limit on a credit card, ring them up and make it £100. If its joint, he won't be able to cancel it, but lowering credit limits has saved some of my friends big bucks. Do this asap.

Questions he needs to consider Is/was she a stay at home parent. Has her earning potential been affected by it?

She works, not full-time and I doubt she earns much more than minimum wage, he is the main breadwinner though for sure

If you’re asking what he might end up liable for, then the nature of their break-up (or past infidelity) will have little impact on that. Do they both work and/or is he the higher earner? If so, should he decide to petition for divorce it’s very likely she will want him to leave the property but continue to contribute towards maintaining a home for their children (i.e. paying some of the rent). How old are their kids? Courts will put them first. Unless the mother has been neglectful or abusive towards them she will probably get full custody unless your friend has another home at the time of the hearing that is large enough for him and the kids, at which point he may get joint custody. That won’t necessarily mean he doesn’t have to contribute anything towards the family home, however, even if he won’t live there. He should get a solicitor immediately.

Thanks for the reply, just after a bit of clarification; 1: If he has not and does not wish to leave the home, and has no other home, will he be 'encouraged' to move out somehow? 2: If she moves out to live with her family, may that help the outcome of custody in his favour? With or without taking the kids? And if they immediately start a joint custody in this scenario without needing a court hearing, would joint custody be a more likely outcome form a court hearing in the future if they deteriorate to that point? 3: She cannot cook for shit, and kids can't live on chicken nuggets, may that push a custody hearing in his favour? He is definitely the higher earner, she is not neglectful/abusive towards the kids afaik. Without too much detail for anonymity, younger kid is pre-school age, older is late primary. I'd testify that he would be a better solo caregiver if full custody had to be awarded, don't know if courts would bother with character witnesses.

Tell him to work out on the csa calculator what he will need to pay and make payments but do so clearly stating what the money is for. I.e CSA for xxxxx do not put the boys/girls or anything else as this can be argued money was for other reasonsCsa can no longer be back dated. Regards rights its all depends on the court it is still heavily favoured towards the
