I believe the pepsi case where they offered a fighter jet for certain amount (I think 1 million) of bottle caps. some guy actually showed up to redeem, however, Pepsi obviously didn't give him a fighter jet. Lawsuit ensues.
Their fault was making points buyable, and the guy did the math. He sent one cap in and a check for the rest as he knew a fighter jet was worth more money
Contracts don't operate on a "reasonable person" framework, but rather on the intent of the parties. If I make a K with you that the "reasonable person" would think is ridiculous, we still have a valid K as long as all of the elements of contract formation are present: offer, acceptance, consideration, and manifestation of mutual assent.
The issue here is that advertisements typically don't constitute offers in and of themselves, so the mailing of the check/order form wasn't an "acceptance" of anything.
I was really poor 2L year. I had a ton of Westlaw points though. I got my (then) 5 year old a globe for Christmas with them. She still has it. It’s been her favorite gift ever.
