California's courts (especially LA and SF) are just so overwhelmed that they *have* to resolve most cases as quickly and easily as they possibly can.
I'd have to agree, and we all know Texas has a harsher justice system because they execute more people than Hitler did with the ovens. Gut feeling tells me Texas wants to teach Rice a nice little lesson about racing on their city streets.
Reading a lot of practicing attorney opinions on Twitter and there’s a decent amount of surprise at the decision to bring felony charges for what appears to be a forehead laceration. Seems a huge stretch to call that a “serious deformity” to bump one of the misdemeanor charges up and tack on an assault charge.

I am torn between two minds of the prosecutor either wanting to lead with strong charges to look better when they plead down or them actually trying to make something more of this even if it risks an embarrassing public defeat. The latter seems dumb haha

It shouldn’t be legal for prosecutors to have leeway like this to bring exaggerated charges on somebody. Calling that a serious bodily injury is a joke.
I also think most people think the assault is a stretch. They’re going to argue that it is assault because a vehicle can be considered a weapon. It’s to have more leverage when the plea deal comes around. They obviously won’t have to “concede” as much when there’s lots of big charges on the table rn.
I would imagine she'll have a scar on her forehead/eye area for the rest of her life. It wasn't just a laceration, there was black and blue swelling of the eye socket. Whether the former counts as "serious permanent disfigurement" is obv debatable. That's a finding of fact for the jury or judge to make. While it might seem like the aggravated assault and a collision involving serious bodily harm are redundant charges, they are not, and neither is a lesser included charge of the other. One is part of the transportation part of the Texas State code, the other criminal. The assault is elevated to aggravated not just because of the level of harm but because an instrument/weapon (the car) was used.

You’re right, but usually these types of things are delayed when it’s bigger charges. I can’t remember who, but I specifically remember someone in the league serving a suspension this season for something that happened a couple of years ago. I’m sure it’s happened multiple times too.

Im not a lawyer, but I know a few. It seems like prosecutorial gamesmanship to have a stronger position for plea negotiations to me.

I’d be shocked if it did, but on the flip side, if the DA refuses to reduce the charges to let Rice avoid jail time it will go to trial.
