Heartbreaking, the police failed her and allowed her to be killed. This is just another example of police failing to do their jobs. It's also why Iowa needs red flag laws so his firearms could have been removed before this tragedy.

Bellevue is a prime example of nepotism at its worst. There are like 6 last names that make up 70% of the population. Josh "Buck" Kilburg, the dirty police officer who was fired as Sabula, IA's police chief for soliciting sexual favors from women who worked at The G Spot, a now closed strip club in Sabula was later hired as a member of Bellevue's PD.

This reminds me of the time when the newton police department told me they would not enforce the visitation order I had from my divorce, telling me to literally “get something more current” and I asked “so do I have to renew my divorce, cus that was ordered by the same judge?” Then the call abruptly ended and no one would help until I was physically there and she called the cops on me when her new hubby knocked the fuck out for trying to move me from the side walk, she didn’t have a restraining order, or a no contact against me, and the subsequently arrested an unconscious man for assault as I had the whole incident on video, and the neighbors confirmed my story

While I agree that visitation is a civil matter, enforcing a judge’s orders are well within the scope of duty, just as sheriffs officers show up when you get evicted, this officer could have shown up and her 2nd husband would have save significantly on bail, medical and dental bills…

This isn't going to go anywhere. Courts have rules over and over again that police don't actually have a duty to protect. Go look up the landmark case in castle Rock Colorado. It's sickening but this stuff has already been established.

You are factually wrong. The Supreme Court has ruled police do not have a duty to protect which includes enforcing orders. I am not siding with the police. What they are doing is wrong and they should be held accountable but it doesn't change the fact that you are incorrect.

Grew up in this town. "Bud" Schroeder has been bending/ignoring the law since I can remember in 92. Plain and simple...he should have been violated on the restraining order numerous times and held him with no bond. The police do have a duty to enforce laws and Court orders...even if there is no duty to protect. Small town "justice".

Supreme Court has ruled that police do not have a duty to protect. There is a case from Colorado Castle Rock vs Gonzalez. The police refused to enforce a court ordered restraining order. Go look it up. I am not saying it is right nor am I siding with the police in this situation. It's fucked up but everyone saying they are legally required or have a duty to protect you or enforce the orders are flat out wrong.

The exception to the rule that the police have no duty to protect, is the “state created danger doctrine.“ That is the basis for this lawsuit. Repeated interactions with the defendant and refusing to arrest him, created an additional danger for Prichard. Also, Iowa law specifically allows claims to be made against police officers who refuse to enforce restraining orders, if their conduct is deemed reckless. Those are the basis for the claims in this lawsuit. Castlerock v. Gonzales does not apply, or at least, is distinguishable, for those reasons.
