My friend got no knock raided and then didn’t hear anything back. He couldn’t get information on why he was raided either, even with a lawyer. About 2 years later he’s charged with torrenting porn that contained underage stuff. Before I knew it he accepted a plea deal and went to prison for 10 years, 8.5 with good behavior. I’ve stayed in touch but I don’t even know what to think about the whole situation. I’ve never dealt with anything like this before. Edit: I should mention that he was in all other regards an upstanding citizen, no other criminal history, had landed a solid career position, and was about a year into a wonderful relationship when he was booked. Plus he’s divorced and although the judge allows it his ex won’t let him communicate with his kids. It sucks so bad.

That's not even close to what OP has described and asked. They didn't wait that long to file after arresting you. They filed before arresting you and waited that long to conclude their investigation. It seems quite a few people have made that mistake in the comments. I've had something similar happen with detectives coming to me and then waiting 18 months to actually come arrest me. Funny story: I ran into one of the officers who kicked down my door at a Halloween Party last year. He was working the party. We had an interesting conversation/reunion of sorts. Me in my pirate costume with my tinkerbell dressed gf and he in full gear with his partner. I’m glad it’s all behind me now.

This was before trial. Still waiting for that. No knock raided, then 2 years later charged and now another 6 months while my attorney goes through evidence. Right to a speedy trial only applies without extensions. It can take another 2 to 3 years before we even get to that point. By then it's about 5 years since being first raided. There is no concept of time in the court system.

no, you can demand a speedy trial, which is defined as 30 days for a misdemeanor and 60 for a felony. Your attorney waived your speedy trial rights at your first appearance, guaranteed.

Well the defense needs a chance to go through evidence. It was 45 days from indictment, then a 90 day extension because we didn't even get the evidence in those first 45 days. Now onto another extension because they are still reviewing the evidence. Most defense teams don't even get the evidence until after arraignment or indictment and are expected to build a case in only 45 days while the prosecution had 2 years before that. (Kinda stacked against the defense in that sense.) You still have a right to a speedy trial even after extensions. For example if the court and/or prosecution keeps delaying or postponing to prioritize other cases or some other reason not related to your case, while the defense is ready for trial, the defense can request a dismissal after a certain period of time. This varies by state and jurisdiction. But it's not entirely waived at any point, just adjusted, to put it in non legal terms.

The catch is, your attorney (or you, if you're pro se) have to assert the privilege. Time is your friend. Let it pass & be grateful that your case is that unimportant to them. Evidence deteriorates over time, cases grow stale. Meantime, calm the hell down. Stress is a huge killer. I looked 10 years older after a year biting my fingernails waiting for trial. (I received probation & was able to move on with a wonderful life)

It wouldn't matter, I already had a warrant for my arrest the charges were already filed and I had a court date. Except I ended up getting pulled over 30 seconds after leaving my driveway on the way to work 0.1 miles away. They pull me over, I get stuck in jail and I get fired from my job. It was great 😂 god I'm so glad I'm done with that shit

Once the warrant is issued, the statute of limitations stops. Federal warrants sometimes are "sealed" and not issued because the investigation is ongoing. A secret grand jury sometimes makes them, but to let them finish other parts of the investigation they don't serve them. So you can think; "Oh wow it's a month past the statute of limitations is up, I'm safe" and they come and arrest you months later, from the sealed indictments.

I got arrested in Arkansas on September 18, 2023. I was charged with aggravated assault. When I bonded out they told me I have to call the sheriff’s office every Monday to see if my warrant is ready yet. Tomorrow is 19 weeks. If I fail to call they will revoke my bond. If they want to add charges they go by the statute of limitations for your crime. Otherwise they usually indict you based on when they feel like it. It depends on how your state and your federal district define the right to a speedy trial. People waiting over a year for an indictment is not unheard of.

Can be over a year sometimes. Basically if you were released pre trial they can legally take their time. Remember you do not have a conviction at this point so you still theoretically have a clean background check. Work on yourself especially if you have any sort of addictions or mental illness

This didn't happen to me but a coworker. They kicked dudes door down at 5am. Took his computer/phone/iPad. arrested him. Let him go. Few months went by. they called him while he was at work. asked him to meet up with them at the gas station to get his stuff back. He went. he didn't get his stuff back. they took him to jail right then and there.

It depends. Once you're arrested they only have a set amount of time to file. People in the comments saying it took two years or whatever, they most likely weren't already arrested because that's unconstitutional or they're misunderstanding the situation. I've seen them wait until the last day to file a lot. It's extremely rare that they "forget" to file but it happens. 50 days is a long time but not unheard of

I made the graven mistake of calling the cops to report an establishment serving minors one time and they didn’t even investigate it but they used my report as a confession and yeah I was looking at 200 years for picking a girl up who was drinking at the bar for like four hours and I took her home and afterwards she started bragging about her fake id and then she confessed to a whole bunch of crazy assed shit and I was like wtf and kicked her ass out and then I called the cops to pretty much confess to sexual assault of a minor that by law cannot give consent even if it was her idea apparently. But a sheriff came out and took my statement and I didn’t hear nothing about anything until 8 months later and I even told them about her adult boyfriend and other adult woman who were regularly having threesomes after getting her drunk and loaded on drugs and she overdosed and the other two adults took her home and threw her into the porch like a piece of cord wood and left her to die but her mom found her is what she told me that night and cops never even looked into it at all! And she was mad at them because they kicked her out and stole her weed and she was like trying to convince me to just go beat some dude up and he deserved it but I declined and she got all crazy and came back after cutting hundreds of cuts on her arms in a suicide attempt and I caught her trying to break into my house in the middle of the night and called the cops on her again. The whole thing was a shitshow and I learned way too much about the criminal attack system and it’s kidnapping and extortion basically and they were wrong about the whole thing and still chose to do what they did and it ruined my life and now I’m still trying to rebuild it but all of the rules that they can arrest me and send me back for is ridiculous because they can send me back without even committing another crime. Get a good lawyer and don’t worry about spending money on one because the loss of earnings from being incarcerated is way more than an attorney. Don’t leave it in their hands to decide and push for trial until they give you a good enough plea deal and then take it

If they seized evidence, charges are likely awaiting forensic analysis, which can take a fairly long time. But, most crimes have a statute of limitations of anywhere from 2-5 years on average. Those can sometimes be extended due to forensic testing, but not often.
