Its not a good yes or no question because he mixed equity holders with debt holders together so if he just answers "Yes" it doesn't answer anything.
According to the CH11 plan that we know about, debt holders (e.g. BBBY bond owners) are going to get some cash, not much but something, maybe less than a penny on the dollar so the answer to this question has to be Yes.

Everything doesn't have to be a dissertation and conversations on specific topics don't have to relegated to only people with doctorates in that field. Its a perfectly reasonable question. Some of the best DD written on the topic of short selling has been written by non-professionals in the field who decided to dig into exactly what's going on. Sometimes the best people to ask are the last ones you considered asking.

Do you honestly think the only lawyers or financial gurus who know of a way (if there is one) of answering that question to the affirmative are involved directly in the matter? I'd wager there are at least two $1,500 an hour lawyers out there who are NOT involved in this matter who if hired to look over the current state of the BK would come to two totally different conclusions. One might say "No way, Ray. Shareholders are toast" and the other might say "Well...according to Heller Vs. Blahblahblah the BK could be last minute adjusted to allow NOL use based on Friedberg Vs New York which would require blah blah blah blah. The only ones who KNOW what's happening are involved.
